CONTEST OFFICIAL RULES

No purchase is necessary to enter or win. A purchase does not affect or improve your chance of winning.
CONTEST PERIOD
The Contest begins on May 15, 2010 and ends on June 17, 2010.
ELIGIBLE CONTESTANTS
This Contest is open to all legal residents of the United States and District of Columbia, and U.S. Military Personnel (and their families) with APO/FPO addresses, who are eighteen (18) years of age or older (void in Puerto Rico). Participation in this Contest constitutes entrant’s full and unconditional acceptance of these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to the Contest.
This Contest is void where prohibited, taxed, or otherwise restricted by law, and is subject to all federal, state and local laws.
PRIZES
The winning prize is $250.00 deposited into the Gimmepleez.com members’ account that is linked to the website. If the winner does not have an account linked to the website, they must link a checking or saving account in order to claim the winning prize. The odds of winning are 1 in 400.
Prizes will be awarded within thirty (30) days following the conclusion of the Contest Period. All warranties for prizes are hereby disclaimed, and the winner will accept the prize “as is.” Non-cash prizes cannot be assigned, transferred, exchanged or redeemed for cash. Taxes and fees, if any, are the responsibility of the winner.
Sponsor reserves the right to provide a substitute prize of same type and value.
HOW TO WIN
During the Contest Period, eligible participants who generate the most unique page views to their profile page during the Contest dates will be the winner. Unique visitors are measured according to their unique IP addresses, which are like online fingerprints, and unique visitors are counted only once no matter how many times they visit the site. A members “Profile Page” is defined as www.gimmepleez.com/profile/(unique address to each member).
NOTIFICATION
Winners will be notified by email at the email address provided at the time of entry. Sponsor assumes no responsibility for notices that are not delivered for reasons outside of its control, including, but not limited to, instances where the user provided the wrong email address, the termination or abandonment of the user’s email account, the use of “spam” or “junk mail” filters, or rejection by the user’s email service provider for any reason.
If the Contest is terminated due to tampering or technical difficulties prior to the expiration date, notice will be emailed to each entrant and/or posted at http://www.gimmepleez.com.
DISPUTES
Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages (other than for actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction) that would case the application of the laws of any jurisdiction other than the State of California.
RULE CHANGES
Sponsor may change these Official Rules at any time before the end of the Contest Period and without specific notice to entrant, in accordance with California law. Changes to these Official Rules posted on Sponsor’s website (http://www.gimmepleez.com) will constitute proper notice to entrant. It is the entrant’s responsibility to review the Official Rules and all correspondence from Sponsor or its agents regularly to ensure compliance with the current Official Rules.
RELEASE
By participating, entrants agree to release and hold harmless Sponsor and its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, counsel, prize suppliers, and agents (collectively the “Released Parties”) from and against any damages, claim or cause of action, for injuries, damages or losses to persons and property which may be sustained in connection with participation in this Contest.
By receipt of any prize, winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the contest or receipt or use or misuse of any prize.
MARKETING
Entrant grants permission to Sponsor to use entrant’s name, age, city, state, photograph or likeness for advertising and promotional purposes without additional compensation or approval.
SEVERABILITY
If any term or provision of these Official Rules or any part thereof are declared illegal, null or void, the remaining portions of these Official Rules shall remain in full force and effect to the extent permitted by law.
SPONSOR
This Contest is sponsored by Gift of College, Inc., a California corporation. Sponsor reserves the right to cancel or modify the Contest at any time and/or substitute another promotion in its place.
